Frequently Asked Divorce Questions
An uncontested divorce means that both parties have resolved all issues before the divorce is filed in court. Once filed in court, all the judge has to do is sign off on the final order granting the divorce.
A court of competent jurisdiction (Circuit Court) can grant a divorce as long as sufficient evidence has been presented that there are adequate grounds for divorce such as: disagreements, incompatibility of temperament, abandonment, abuse, adultery etc.
No. You can file the divorce on your own. The matter will be set for a hearing and, after testimony, the Court will grant the divorce as long as all parties have been properly served, the divorce complaint was filed in the correct county, and there are no reasons to stop the divorce from going through (such as one party is in the military, one party is incompetent or underage, one party is deathly ill, etc.).
JOINT CUSTODY - the parents share decision making as it relates to the minor child and the both parents have substantial contact with the minor child
***If the parents get along well, the courts often favor "JOINT CUSTODY"
JOINT LEGAL CUSTODY - both parents have equal rights and responsibilities for major decisions concerning the minor child.
JOINT PHYSICAL CUSTODY - does not necessary mean there is equal time spent at each parents' home, but it does mean that the minor child has SUBSTANTIAL contact with each parent.
SOLE LEGAL CUSTODY - one parent has the sole responsibility for making all major decisions involving the minor child
SOLE PHYSICAL CUSTODY - one parent has primary custody of the minor children and the other parent has visitation rights
If someone has purchased something in your name or used your social security number without your permission, IMMEDIATELY file a police report, then contact EXPERIAN, EQUIFAX, and TRANSUNION and inform each agency that you would like to place a FREE credit freeze on your account. Instruct each agency that you believe you may have been the victim of identity theft. Pull a copy of all three credit reports and contact each company that is listed that states you did business with them and (you didn't) and inform them that you have been the victim of identity theft and ask them to void the purchase or transaction. Please have a copy of your police report just in case they ask for it.

The Easiest Way to Transfer Property in Alabama outside of a will is: - Life Insurance (Name a Beneficiary), Retirement Proceeds (Name a Beneficiary), Deed (Right of Survivorship), Bank Accounts (Name a Beneficiary), Car (Change the title before death)........but say you did none of that and you died without a will and ---what happens? Intestate laws will generally determine the distribution of your assets.
TRUSTS: Many people inquire about placing assets in a revocable trust so that their heirs don't have to probate the estate; trust documents are complicated; each question by the trustee related to the trust will require consultation with a lawyer who generally will charge a fee. These questions generally relate to transferring assets in and out the trust. Unless there is a specific stated reason for a trust (governmental assistance, taxes, allocations to minor children, etc), trusts are not recommended for simple estates.
